Brown University FileMaker Pro User Agreement

FileMaker Pro is being provided to you through a license agreement between Brown University and FileMaker, Inc. Assistance with installation and problems occurring during use of FileMaker may be obtained by contacting the CIS Help Desk. By obtaining this software, you agree to the terms and conditions of the FileMaker license agreement, amendments, and terms under which Brown University is making this product available. Relevant restrictions are summarized below:

• The use of this software is restricted to faculty, staff, and current students of Brown University.
• You may not sell, rent, lease, or transfer the software to a third party.
• THIS SOFTWARE IS DISTRIBUTED "AS IS" WITHOUT WARRANTY OF ANY KIND, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. UNDER NO CIRCUMSTANCES CAN BROWN UNIVERSITY, ANY OF ITS DEPARTMENTS OR STAFF BE HELD RESPONSIBLE FOR PROBLEMS DURING INSTALLATION OR USE AND ANY DAMAGES INCURRED AS A RESULT THEREOF.
• Under no circumstances, including negligence, shall FileMaker, Inc. be liable for any incidental, special or consequential damages that result from the use or inability to use the software.
• Licensee acknowledges that the Software contains trade secrets and to protect them, Licensee may not decompile, reverse engineer, disassemble or otherwise reduce the Software to any human-perceivable form except as permitted under applicable law. Licensee may not modify, sell, rent, lease, loan, distribute (except as expressly permitted by this License), or create derivative works based upon the Software in whole or in part.
• Licensee shall: (i) not remove any copyright notices or proprietary legends from the Software; (ii) reproduce on all copies of the Software the copyright notice and any other proprietary legends that were on the original copy of the Software; (iii) not disclose the unique Install Code to anyone except authorized users under this License; and (iv) take reasonable steps to ensure that each user of the Software is aware of and complies with the terms and conditions of this License, including any Special Terms provided for the Software.
• THE SOFTWARE IS NOT INTENDED FOR USE IN THE OPERATION OF NUCLEAR FACILITIES, AIRCRAFT NAVIGATION, COMMUNICATIONS SYSTEMS, OR AIR TRAFFIC CONTROL OR SIMILAR ACTIVITIES IN WHICH CASE THE FAILURE OF THE SOFTWARE COULD LEAD TO DEATH, PERSONAL INJURY, OR SEVERE PHYSICAL OR ENVIRONMENTAL DAMAGE.
• Export Law Assurances. Licensee may not use or otherwise export or reexport the Software except as authorized by United States law and the laws of jurisdiction in which the Software was obtained. In particular, but without limitation, the software may not be exported or reexported (i) into (or to a national or resident of) any U.S. embargoed country or (ii) to anyone on the U.S. Treasury Department's list of Specially Designated Nations of the U.S. Department of Commerce's Table of Denial Orders. By using the Software you represent and warrant that you are not located in, under control of, or a national or resident of any such country or on any such list.
